为了方便外籍人士查阅杭州市地方性法规和政府规章,按照国务院法制办公室对法规规章译审工作的要求,杭州市人民政府法制办公室选择了现行有效的部分地方性法规和政府规章编辑出版了《杭州市法规规章汇编(中英文对照)》。本书收录了1988年至2005年杭州市人大常委会和杭州市人民政府制定公布的地方性法规和政府规章共19件,其中地方性法规11件,政府规章8件。按发布时间先后顺序,地方性法规在前,政府规章在后。
本书由杭州市人民政府法制办公室全权委托浙江省法制研究所翻译、审定和印制。凡英文译文和中文原文表述不一致的,以杭州市人大常委会公报和杭州政报刊登的中文文本为准。

根据1997年6月25日杭州市第九届人民代表大会常务委员会第三次会议通过 1997年7月30日浙江省第八届人民代表大会常务委员会第三十八次会议批准的《杭州市人民代表大会常务委员会关于修改<杭州市环境噪声管理条例>等七件地方性法规个别条款的决定》第一次修正。
根据2001年8月17日杭州市第九届人民代表大会常务委员会第三十六次会议通过2001年11月2日浙江省第九届人民代表大会常务委员会第二十九次会议批准的《杭州市人民代表大会常务委员会关于修改<杭州市城市绿化管理条例>部分条款的决定》第二次修正。

第一章 总则
第一条 为了加强城市绿化的规划、建设、保护和管理,适应风景旅游城市发展的需要,改善城市生态环境,根据法律法规的有关规定,结合本市实际情况,制定本条例。
第二条 本条例适用于杭州市城市规划区内的各项绿化活动和各类绿地及其设施的规划、建设、保护和管理。
第三条 城市绿化应当合理配置植物类型,注重绿化工程的功能以及生态效应和景观要求。
市城市绿化行政主管部门应当组织力量加强树木、花草的科学技术研究,培育优良品种,适应城市绿化的要求。
第四条 本条例所称城市绿化是指植树、种草、栽花、育苗及管护等绿化活动。
本条例所称城市绿地包括:各种公园、绿化广场等公共绿地;居住区配套绿地;各单位附属绿地;花圃、苗圃等生产绿地;用于城市卫生、安全隔离等目的的防护绿地;风景林地。
本条例所称的现有绿地,是指已建成的绿地以及已列入年度建设计划的待建绿地。规划绿地是指杭州市城市总体规划和城市绿地系统规划确定的城市绿化规划用地。
第五条 绿化城市,人人有责。各级人民政府应积极组织开展全民义务植树活动。凡是条件具备的地方,年满十一岁的公民,除老弱病残者外,都应因地制宜,每人每年义务植树三至五棵,或者完成相应劳动量的育苗、管护和其他绿化任务。
城市各单位应负责本单位的环境绿化,并要完成当地政府分配的绿化任务。
城市居民应负责搞好自己住所的环境绿化。
第六条 对城市绿化和绿地管理有显著成绩的单位和个人,以及对检举揭发破坏城市绿化,保护树木、绿地有功的单位和个人,可由各级人民政府或城市绿化行政主管部门给予奖励。
第七条 市人民政府城市绿化行政主管部门统一管理全市城市园林绿化工作,负责指导、协调和检查各城区的绿化工作,并直接负责西湖风景名胜区及市管行道树的绿化及管护工作。
各区城市绿化行政主管部门,负责本辖区的绿化管理工作,并负责所属街道及辖区的机关、部队、企事业单位和人民团体的绿化工作进行督促、检查和指导。
各街道办事处协助城市绿化行政主管部门督促、检查管辖范围内的单位、住宅小区、居民区宅院的绿化和管护工作。
第二章 规划管理
第八条 市人民政府应当制定高于国家规定的城市绿化总体目标,并组织规划行政主管部门和城市绿化行政主管部门编制城市绿地系统规划。
城市绿地系统规划应当纳入杭州市城市总体规划,并列入国民经济和社会发展计划。
第九条 建设工程项目的配套绿地指标应符合下列规定:
(一)新区开发建设的住宅区和零星建设的住宅绿地率不得低于30%,其中居住区级公共绿地人均面积不得低于1.5平方米,小区级不得低于人均1平方米,组团级不得低于人均0.5平方米;
(二)旧城改造建设的住宅区和零星建设的住宅绿地率不得低于25%,其中居住区级公共绿地人均面积不得低于0.75平方米,小区级不得低于人均0.5平方米,组团级不得低于人均0.25平方米;
(三)旧城区干道两侧新建影剧院、饭店、商业楼、大会堂等大型单体公共建筑,绿地率不得低于15%;
(四)一般工厂、仓储设施、港口、码头、集装箱集散地、车站、停车场、大型煤场、专业性市场的绿地率不得低于20%;
(五)化工、印染、造纸、制革等排放有毒有害物质的工厂绿地率不得低于30%,其中厂区与生活区之间应设置一定宽度的绿化隔离带;
(六)学校、疗养院、医院、部队营区、机关团体、公共文化设施、宾馆、饭店、招待所等建筑物的绿地率不得低于35%,商业楼不得低于30%,商住综合楼不得低于20%;
(七)城市主干道绿地率不得低于20%,次干道不得低于15%;
(八)其他建设工程项目的绿地率不得低于25%。
前款规定的建设工程项目配套绿地率指标,建设工程项目在西湖风景名胜区范围内建设的,应提高15个百分点,在西湖风景名胜区外围保护区建设的,应提高5个百分点;前款第四项至第八项规定的建设工程项目配套绿地率指标,建设工程是旧城改造建设,且在西湖风景名胜区及其外围保护区外的,可降低5个百分点。
市人民政府应当根据经济和社会发展的要求制定不得低于本条第一、二款规定的建设工程项目配套绿地指标。
第十条 除城市道路和住宅建设工程项目外,新建建设工程项目确因建设工程用地紧张等特殊原因绿地率低于第九条规定5个百分点(含5个百分点)以内的,经市规划行政主管部门和市城市绿化行政主管部门批准,建设单位应当就近易地建设与配套绿地不足部分同等面积的绿地;无法就近易地建设的,应当向市城市绿化行政主管部门缴纳城市绿化补偿费。
城市绿化补偿费应当包括应建绿地不足部分的土地费用以及绿化工程建设费用和5年绿化养护费用。
第十一条 建筑物和构筑物应当与树木保持合理的间距,确保树木生长不受影响。
建设工程项目定点时,市规划行政主管部门应当按第九条的规定提供建设工程项目的规划设计条件;建设用地范围内有树木的,市规划行政主管部门应当事先征求市城市绿化行政主管部门意见。
第十二条 建设工程项目的配套绿化工程应当按第九条规定和有关技术规定进行绿化工程设计。在建设工程项目设计方案审查时,应当有城市绿化行政主管部门参加审查。
第十三条 配套绿化工程施工应当与主体工程同步规划、同步实施,并在主体工程竣工后的第二个绿化季节内交付使用。
第三章 保护和管理
第十四条 树木所有权和收益归属按下列规定处理:
(一)城市绿化行政主管部门依靠专业队伍和发动群众在公共绿地上种植的树木,归国家所有。
(二)西湖风景名胜区的山林,按山林定权发证的有关规定执行。
(三)机关、部队、企事业单位和人民团体在用地范围内自行投资种植并管护的树木,归单位所有。
(四)城市住宅小区列入配套项目种植的树木,归业主所有。
(五)城市私人庭园内自费种植、管护的树木,归个人所有。庭园土地被国家划拨、出让给他人使用时,其树木按有关规定作价处理,或由树木所有人移植。
第十五条 无论公有或私有树木的砍伐、迁移,都要报市城市绿化行政主管部门审批。未经批准,任何单位或个人不得砍伐或迁移树木。
第十六条 建设单位申请砍伐、迁移非本单位所有的树木,应按城市绿化行政主管部门规定的标准,承担砍伐或迁移的人工费、运输费及补偿绿化费。凡砍伐后不能进行绿化的,须赔偿树木损失费。
第十七条 任何单位或个人不得擅自挖掘城市绿地和修剪树木。当管线建设需要修剪或挖掘树木时,应在城市绿化行政主管部门指导下进行。
第十八条 百年以上的树木或稀有、珍贵树种以及具有历史价值和纪念意义的树木,均为古树名木,要严加保护,严禁砍伐。城市绿化行政主管部门对古树名木要统一建立档案和标志,加强养护管理。在各单位内和私人庭院内的古树名木,由各单位和居民管护,城市绿化行政主管部门负责监督、定期检查和技术指导。
第十九条 在有古树名木生长的区域内进行建设,建设单位在规划、设计、征用土地和施工过程中,应严格注意保护古树名木,并与城市绿化行政主管部门共同研究制定避让或保护措施,不得任意修枝,伤根及迁移。
第二十条 现有城市绿地和规划绿地,任何单位和个人不得擅自占用、改变用地性质或者破坏其地形、地貌、水体和植被。
确因建设工程无法避让或其他特殊原因需要占用现有绿地的,除城市道路工程建设需要外,应就近易地建设同等面积的绿地;不能就近易地建设同等面积绿地的,经批准后,向市城市绿化行政主管部门缴纳城市绿化补偿费。
占用现有绿地的,需经市城市绿化行政主管部门审查同意,并经规划、土地行政主管部门依法审批。
确因建设工程需要借用现有绿地的,应当先征得市城市绿化行政主管部门的同意,向市城市绿化行政主管部门缴纳城市绿化补偿费。现有绿地的借用期限不得超过2年。借用单位应当在借用期满后的3个月内负责恢复原状,逾期不能恢复原状的,可按擅自占用现有绿地论处。
第二十一条 临时绿地的管理办法由市人民政府规定。
第二十二条 任何单位或个人在城市绿地内不得毁损花木、排放污物、堆放货物、挖沙取石、倾倒废弃物、割草取土、放牧捕猎、开垦种菜,不得擅自设置饮食、照相、小卖等服务摊点。
第二十三条 城市绿化行政主管部门要建立健全园林绿地的管理制度,保证树木花草茂盛、园容整洁美观、设施完好;要做好对风灾、雪灾、水灾、旱灾、火灾、病虫害等自然灾害的防御、救护工作,做好树木花草特别是古树名木的保护工作。
第四章 费用管理
第二十四条 由市城市绿化行政主管部门直接建设和管理的公共绿地、防护绿地、风景名胜区的绿化和养护费,除在城市维护费中列支外,还应多渠道筹集资金。
第二十五条 实行物业管理的住宅小区的绿化养护费用,在物业管理经费中列支,具体标准由市价格行政主管部门制定。
各单位范围内及门前包干区的绿化养护费用,由各单位自理。
鼓励单位、个人认养绿地。
第二十六条 在杭各单位凡未按规定完成当地政府下达的当年义务植树任务的,应向城市绿化行政主管部门缴纳绿化费,具体标准由市人民政府规定。收缴的绿化费,应专款用于城市绿化。
第二十七条 建设单位应按设计完成本单位内的绿地建设。凡有条件绿化而未达到绿化标准的单位,市城市绿化行政主管部门应规定其完成期限。超过期限仍未完成的,城市绿化行政主管部门按有关规定收取绿化费及绿化延误费,并负责代为绿化。
凡在城市规划区范围内依法取得土地使用权的建设单位,在拆迁完毕后6个月内不能开工建设的,应当对所取得的地块实施临时绿化。
第二十八条 城市绿化行政主管部门按本条例收取的有关绿化费用,应当实行财政专户储存,专项用于绿化建设。
第五章 法律责任
第二十九条 违反本条例规定,有下列行为之一的,由市、区城市绿化行政主管部门给予批评教育,责令改正,恢复原状;造成损失的,赔偿损失,并可按以下规定处罚:
(一)损坏草坪、花坛和绿篱的,栓钉刻划树木,攀折花木的,可处以10元以上100元以下的罚款,剥刮树皮等严重影响树木生长的,可处以100元以上500元以下的罚款;
(二)在绿地内擅自割草、采沙、取土取石的,排放污物、倾倒废弃物、堆放货物有损绿地的,在绿地内放牧、捕猎、开垦种植的,可处以50元以上200元以下的罚款;
(三)擅自围圈树木妨碍树木生长的,擅自在绿地内设摊的,可处以200元以上1000元以下的罚款。
第三十条 擅自占用现有绿地,擅自迁移、砍伐、毁坏树木或毁坏绿化设施的,由市、区城市绿化行政主管部门责令退还绿地,恢复原状,赔偿损失,并处以绿地造价、树木价和绿化设施价2至10倍的罚款,并对直接责任人处以500元以上5000元以下罚款。罚款的具体标准由市人民政府制定。
毁坏古树名木的,责令其赔偿经济损失,并处以1000元以上30000元以下的罚款,对直接责任者处以500元以上2000元以下的罚款;砍伐或者毁坏古树名木致死的,除责令其赔偿经济损失外,并可处以30000元以上100000元以下的罚款。对直接责任人处以2000元以上5000元以下的罚款。
第三十一条 违反本条例规定,有下列行为之一的,由市城市绿化行政主管部门按以下规定处罚:
(一)建设工程项目的主体工程竣工后的第二个绿化季节内未按时绿化的,由市城市绿化行政主管部门指定单位代为完成,绿化建设费用由建设单位承担;拒不缴纳绿化建设费用的,应处以绿化建设费用1倍以上1.5倍以下的罚款;
(二)建设工程项目的主体工程竣工后的第二个绿化季节内建设工程的配套绿地指标不符合规定,又不按规定补建绿地或缴纳城市绿化补偿费的,应处以应缴城市绿化补偿费1倍以上1.5倍以下的罚款;
(三)绿化工程方案未达到绿化要求的,责令限期改正;逾期不改正的,由市城市绿化行政主管部门指定单位代为完成,绿化建设费用由建设单位承担。
第三十二条 对破坏树木和绿地的,对拒绝或阻碍城市绿化管理人员依法执行管护任务的,由公安部门按照《中华人民共和国治安管理处罚条例》有关规定处理。
第三十三条 任何单位违反本条例规定的,除处罚直接责任人员外,同时处罚负有领导责任的主管人员。
城市绿化管理人员工作失职、玩忽职守的,按行政管理权限给予行政处分。
第三十四条 违反本条例规定触犯刑律的,依法追究刑事责任。
第六章 附则
第三十五条 本条例自公布之日起施行。1984年10月8日杭州市人民政府发布的《杭州市城市绿化保护管理办法》同时废止。
城市绿化涉及公园规划、建设和管理的,适用《杭州市公园管理条例》。

Congress.

Chapter I General Provisions
Article 1 With a view to strengthening the
planning, construction, protection and administration
of urban greening, meeting the needs of the
scenic-tourist city, improving the urban ecological
environment, these Regulations are formulated
according to relevant laws and administrative
regulations and with full consideration to
the actual circumstances of this Municipality.
Article 2 These Regulations apply to the planning,
construction, protection and administration
of all greening projects, all kinds of greenbelts
and facilities in the planned urban areas
of Hangzhou.
Article 3 Urban greening shall allocate reasonably
plant varieties, emphasize the function of
greening projects, ecological effects and
scenic requirements.
The competent department of city greening
administration of the people's government
of the city shall spare no effort to strengthen
the research on the science and technology
of trees, grass and flowers, to cultivate
strong competitiveness, and to meet the needs
of the requirements of urban greening.
Article 4 In these Regulations, urban greening
shall mean the greenery activity of planting
trees, grass, and flowers, cultivating seedlings,
administration and protection.
In these Regulations, urban greenbelts shall
include: all public green spaces such as parks,
greenery squares etc; auxiliary green spaces
of residential quarters; attached green spaces
of units; productive plantation areas such
as nursery for plants, etc; avenue green buffers
for the protection of urban sanitation and
safety; scenic forest lands.
In these Regulations, present green spaces
shall mean built-up green spaces and green
space plots to be constructed in the yearly
construction plan. Planned green spaces shall
mean urban planning land for greenbelts defined
in the comprehensive plan for the city and
the urban green space system planning.
Article 5 Urban greening, it is everyone’s
responsibility. The people's government at
various levels shall organize all the citizens
to plant trees as an obligatory duty and conduct
greening activities. Except for the old, weak,
sick and disabled, each citizen aged 11 or
over shall plant compulsorily three to five
trees each year according to their own conditions,
or finish the relative equivalence of greenery
assignment of cultivation, protection and
other assignments. Each urban unit shall have
the responsibility of greenery of their own
unit and achieve greenery assignments allocated
by the local government. Urban residents shall
have the responsibility of greenery of their
own domicile.
Article 6 The people's government at various
levels or the competent department of city
greening administration of the people's government
of the city private shall award organizations
or individuals who have made outstanding achievements
in connection with urban greening, greenbelts
administration, or have brought accusation
against and muckraked sabotaging urban greening,
or have protected successfully trees and greenbelts.
Article 7 The municipal greening administrative
department is the competent authority of the
greening of gardens and public parks of Hangzhou
Municipality, which is responsible for guiding,
coordinating and inspecting the greening performance
of district administrative departments of
greening, and directly is responsible for
greening, administration and protection of
Westlake Scenic Areas and city avenue trees.
The district administrative departments of
greening are responsible for greening administration
within their respective jurisdictions and
responsible for supervising, inspecting and
guiding greening of government authorities,
troops, enterprises and institutions, and
mass organizations within their jurisdictions.
Assisting the municipal greening administrative
department, sub-district offices are responsible
for supervising, inspecting greening, administration
and protection of units, residential quarters
and gardens of residential areas within their
jurisdictions.
Chapter II Planning Administration
Article 8 The people's government of the city
shall formulate a compressive objective of
urban greening which is higher than the provisions
of the State, and shall organize the competent
department of city planning administration
and city greening administration to compile
the urban green space system planning.
The system of urban greenbelts plan shall
be incorporated with the comprehensive plan
for the city and the undertakings in the national
economy and social development plan.
Article 9 The auxiliary green space index
of constructive projects shall accord with
the following provisions:
1. The ratio of green space of newly-developed
residential quarters and sporadic-built housing
shall be less than 30%, and the per capita
public green space of residential district,
residential quarter and housing cluster, shall
not be less than 1.5 square meter, 1 square
meter and 0.5 square meter respectively.
2. The ratio of green space of residential
quarters and sporadic-built housing in urban
redevelopment areas shall be less than 25%,
and the per capita public green space of residential
district, residential quarter and housing
cluster, shall not be less than 0.75 square
meter, 0.5 square meter and 0.25 square meter
respectively.
3. The ratio of green space of newly-built
large-scale independent public constructions
at both sides of major streets of old urban
districts, such as cinemas, opera houses,
restaurants, commercial buildings, great halls,
etc, shall not be less than 15%.
4. The ratio of green space of ordinary factories,
warehouses, ports, yards, container terminals,
stations, parking lots, large-scale coal depots,
specialized markets shall not be less than
20%.
5. The ratio of green space of factories discharging
toxic or harmful substances, such as chemical,
dying, paper-making and leather factories,
shall not be less than 30%, in addition, green
belts with certain width shall be constructed
between factory district and living district.
6. The ratio of green space of schools, sanatoriums,
hospitals, troop quarters, government authorities,
public cultural buildings, hotels, restaurants
and reception houses shall not be less than
35%, the ratio of green space of commercial
buildings shall not be less than 30%, the
ratio of green space of general buildings
of commerce and living shall not be less than
20%.
7. The ratio of green space of major urban
streets shall not be less than 20%, as for
minor urban streets shall not be less than
15%.
8. The ratio of green space of the rest of
constructive projects shall not be less than
25%.
As for the constructive projects within Westlake
Scenic Areas, the auxiliary green space index
determined by the preceding clause shall be
up 15%, and as for the constructive projects
around Westlake Scenic Areas, shall be up
5%; as for the constructive projects in old
urban districts and outside Westlake Scenic
Areas and its protective areas, the auxiliary
green space index determined by Items (4)-(8)
of the preceding clause may be down 5%.
According to needs arising from the city's
economic and social development, the people's
government of the city shall formulate the
auxiliary green space index of constructive
projects which is not lower than Clause (1)
and (2).
Article 10 Except for constructive projects
of urban streets and housing, approved by
the competent department of city planning
administration and city greening administration,
because of special reasons such as the shortage
of constructive project land, the ratio of
green space of new constructive projects may
be lower 5% (including 5%) than Article 9
formulation. Constructive units shall find
another space as close as possible and construct
a green space equivalent to the shortage of
auxiliary green space. If failing to construct
as close as possible, the competent department
of city greening administration shall charge
fees of indemnity for urban greening.
Fees of indemnity for urban greening shall
include land fees which shall be constructed
to remit the shortage of auxiliary green space,
constructive fees of greening projects and
five-year’s maintenance fees.
Article 11 Constructions and con-constructions
shall keep suitable distance with trees in
order to not affect trees’ growing.
The competent department of city planning
administration shall provide planning design
requirements of constructive projects according
to Article 9 while determining the sites for
projects; if there are trees within the sphere
of constructive land, the proposals of city
greening administrative departments shall
be solicited.
Article 12 The auxiliary greening program
of constructive projects shall be designed
according to Article 9 and relative technological
specifications. The competent department of
city greening administration shall participate
in the examination of designing plan of constructive
project.
Article 13 The construction of auxiliary greening
program shall be planed and built together
with the principal part of the project, moreover
shall be commissioned in the second greening
season after the completion of principal part.
Chapter III Protection and Administration
Article 14 The ownership and uses of trees
shall accord with following provisions:
1. Through the effort of the professional
staff and the masses mobilized, trees planted
by the competent department of city greening
administration shall be owned by the state.
2. Forests in the Westlake Scenic Areas shall
be registered and recorded, certificates shall
be issued certificates and the ownership and
the right to use shall be confirmed in line
with the relevant provisions.
3. Trees planted, administrated and protected
self-fundedly by government authorities, troops,
enterprises and institutions, and mass organizations
in its own land shall be owned by itself.
4. Trees planted as an auxiliary program in
urban residential districts shall be owned
by proprietors.
5. Trees planted, administrated and protected
self-fundedly in urban private gardens shall
be owned by private individuals. When the
land of garden has been allocated for use
by the State or transferred to others, trees
shall be compensated by conversion into cash
payment according to relative regulations,
or shall be transplanted by owners.
Article 15 The cutting and transplantation
of publicly-owned and privately-owned trees
shall be approved by the competent department
of city greening administration. Without approval,
no unit or individual shall cut or transplant
trees.
Article 16 Constructive units shall pay labor
fees of cutting or transplantation, transportation
fees and compensation fees for greening in
line with the relevant provisions of the competent
department of city greening administration,
while applying for cutting or transplanting
trees non-self-owned. If the space cannot
be regreened after cutting, constructive units
shall be charged with the indemnification
loss of greening.
Article 17 No unit or individual shall dig
urban green spaces and trim trees without
authorization. If the construction of urban
ducts needs to cut or dig trees, this shall
be guided by the competent department of city
greening administration.
Article 18 Old and famous trees shall include
more than one hundred-year ancient trees,
rare or precious trees, and trees of great
historical value and memorial significance,
and shall be protected strictly and shall
forbid cutting. With a view to strengthening
the maintenance and administration of old
and famous trees, the competent department
of city greening administration shall establish
recorders and signs. Old and famous trees
in units’ space or private gardens shall be
maintained and protected by units or individuals,and
the competent department of city greening
administration shall exercise supervision,
periodical inspection and technological guidance.
Article 19 Constructive units shall pay great
attention to the protection on old and famous
trees in the areas of old and famous trees,
and shall cooperate with the competent department
of city greening administration in researching
and formulating measures of avoiding and protection.
Constructive units shall not to trim, damage
roots and transplant trees arbitrarily, in
the course of planning, designing, requisition
of land and construction.
Article 20 As for present urban green spaces
and planned green spaces, no unit or individual
shall occupy, change the usage of the land,
or destroy its topography, features, water
bodies or vegetation without authorities.
Except for the needs of constructive projects
of urban streets, constructive units shall
find another space as close as possible and
construct a green space equivalent to the
green space, if they occupy present urban
green spaces, because of failing to avoid
or other special reasons; if failing to construct
a green space equivalent to the green space
as close as possible, with approval of the
competent department of city greening administration,
constructive units shall pay compensation
fees for urban greening.
The occupation of present green spaces shall
first pass the examination of the competent
department of city greening administration
and get its approval, then get approvals of
the competent departments of city planning
administration and land administration.
In case of necessary occupation of present
green spaces, upon examination and approval
of the competent department of city greening
administration firstly, compensation fees
for urban greening shall be charged by the
competent department of city greening administration.
The time limit of occupation shall not be
more than two years. The party of occupation
shall make restoration in three months after
expiration of occupation. For an occupation
of land in excess of time limit, the occupation
shall be regarded as occupied without authorities.
Article 21 For the administration of temporary
green spaces, the municipal people’s government
shall formulate administrative procedures.
Article 22 No unit or individual shall damage
trees or flowers, discharge sewage and excrement,
place goods, dig green spaces for sand or
rocks, dump garbage and other wastes, cut
grass for soil, graze and hunter, reclaim
for vegetables in urban green spaces. Service
booths, such as foods and drunks, photo studios
and small shops, shall be prohibited to set
arbitrarily.
Article 23 The competent department of city
greening administration shall establish and
perfect the administrative system of gardens
and public parks, with a view to prospering
trees and flowers, making garden appearance
clean and fine, and keeping installations
perfect; shall do a good job of defending
and salvaging the natural disasters caused
by winds, snows, floods, fires, droughts and
pests; shall do a good job of protecting trees,
flowers and grass, especially old and famous
trees.
Chapter IV Expense Administration
Article 24 Except the funds allocated for
greening and maintenance of public green spaces,
green buffers and scenic areas shall be dispensed
in the fees of city maintenance, the funds
shall be raised through pluralistic channels.
Article 25 The fees of greening maintenance
shall be dispensed from the expenses of realty
management services in residential quarters
realty management services and the specific
standards shall be determined by the competent
department of pricing authorities.
The fees of greening maintenance for the sphere
of units and the responsibility areas in front
of gates shall be raised by units.
Units and individuals shall be encouraged
to maintain green spaces.
Article 26 If units in Hangzhou Municipality
fail to accomplish the assignment of compulsory
planting determined by the government, fees
of greening shall be paid to the competent
department of city greening administration
and the specific standards shall be determined
by the people's government of the city. Fees
of greening charged shall be utilized to urban
greening exclusively.
Article 27 Constructive units shall accomplish
greening within their own units in line with
desinging plan. If constructive units are
capable of accomplishment, but they do not
reach the greening standards, the competent
department of city greening administration
shall prescribe time limit of accomplishment
for them. In excess of time limit, the competent
department of city greening administration
shall charge fees of greening and fees for
delay in line with the relevant provisions,
and shall accomplish greening instead of constructive
units.
Constructive units obtaining legally the land
use right in urban planned areas shall do
temporary greening, if they fail to start
construction in six months after pulling-down
and relocation.
Article 28 Greening fees charged by the competent
department of city greening administration
in line with these Regulations shall be saved
in special fiscal account and earmarked for
greening only.
Chapter V Legal Liabilities
Article 29 For any of the following acts,
any violator of these Regulations shall be
criticized and educated, and ordered to correct,
and ordered to make restoration by the competent
department of city or district greening administration;
shall make compensation if caused damages
and shall be punished according to following
provisions:
1. Damaging lawns, flower beds and green fences,
maltreating trees such as fastening, craving,
etc, shall be subject to a fine of between
not less than 100 Yuan and not more than 500
Yuan.
2. Without authorization cutting grass, gaining
sand, soil and rocks in green spaces, discharging
sewage and excrement or placing goods and
cause damage, grazing and hunting, reclaiming
in green spaces, shall be subject to a fine
of between not less than 50 Yuan and not more
than 200 Yuan.
3. Without authorization surrounding trees
and hinder the growing of trees, or setting
booths in green spaces, shall be subject to
a fine of between not less than 200 Yuan and
not more than 1,000 Yuan.
Article 30 Occupying present green spaces,
transplanting, cutting trees without authorization,
damaging greening installations, the competent
department of city or district greening administration
shall order to return the land, make restoration,
make compensation, and shall be subject to
a fine which is twice to ten times of the
total amount of fees of greening construction,
cost of trees and fees of greening installations,
and the persons directly responsible shall
be subject to a fine of between not less than
500 Yuan and not more than 5,000 Yuan. The
specific standards of fine shall be formulated
by the people's government of the city.
Damaging old and famous trees, shall be ordered
to make compensation and shall be subject
to a fine of between not less than 1,000 Yuan
and not more than 30,000 Yuan, and the persons
directly responsible shall be subject to a
fine of between not less than 500 Yuan and
not more than 2,000 Yuan; cutting or damaging
old and famous trees to death, shall be ordered
to make compensation, in addition can be subject
to a fine of between not less than 30,000
Yuan and not more than 100,000 Yuan. The persons
directly responsible shall be subject to a
fine of between not less than 2,000 Yuan and
not more than 5,000 Yuan.
Article 31 For any of the following acts,
any violator of these Regulations shall be
punished by the competent department of city
greening administration according to following
provisions:
1.If constructive units fail to green in the
second greening season after the completion
of principal part of construction projects,
the competent department of city greening
administration shall designated other units
to finish greening and fees shall be paid
by constructive units. Refusal to pay the
fees, shall be subject to a fine which is
one to one and half times of the amount of
fees of greening construction.
2. If the auxiliary green spaces finished
in the second greening season after thecompletion
of principal part of construction projects
do not accord with the provisions, and constructive
units refuse to rebuild or pay compensation
fees for urban greening, constructive units
shall be subject to a fine which is one to
one and half times of the amount of fees of
greening construction.
3.Greening projects fail to reach the requirements
of greening, constructive units shall be ordered
to correct within a time limit; refusal to
correct, other units designated by the competent
department of city greening administration
shall do greening instead and fees of greening
construction shall be paid by constructive
units.
Article 32 Any person damaging trees and green
spaces, refusing or hindering staff of city
greening administration to execute assignments
of maintenance and protection, shall be punished
by the public security department, according
to the Regulations of the People’s Republic
of China on Public Security Administration
and Imposition of Punishment.
Article 33 Any unit violating these Regulations,
the persons directly responsible shall be
punished, in addition the persons bearing
leading liability shall be punished as well.
Any member of the competent department of
city greening administration who neglects
his duty shall be given administrative sanction
according to the administrative jurisdiction.
Article 34 Any person violating these Regulations
constitutes a crime shall be investigated
for criminal responsibility according to law.
Chapter VI Supplementary Provisions
Article 35 These Regulations shall go into
effect on the day of their promulgation. The
Regulations of Hangzhou Municipality on Administration
of Urban Greening on October 8th, 1984 promulgated
by the people’s government of Hangzhou Municipality
shall be abolished therefrom.
Urban greening relating to park planning,
construction and administration shall apply
to the Regulations of Hangzhou Municipality
on Administration of Parks.

根据2004年8月27日杭州市第十届人民代表大会常务委员会第十九次会议通过 2004年11月11日浙江省第十届人民代表大会常务委员会第十四次会议批准的《杭州市人民代表大会常务委员会关于修改〈杭州之江国家旅游度假区条例〉的决定修正》
第一条 为合理开发、利用和保护旅游资源,加快旅游设施建设,促进杭州观光度假型旅游业的发展,根据国家法律、法规和有关规定,结合杭州的实际,制定本条例。
第二条 本条例适用于经国务院批准设立的杭州之江国家旅游度假区(以下简称度假区)。
度假区位于杭州市西湖区。
第三条 度假区的开发建设和管理,实行国家旅游度假区的特殊政策和新型管理体制,使度假区成为旅游度假和观光相结合,符合国际旅游度假要求,以接待境外旅游者为主的综合性的国家旅游度假区。
第四条 鼓励境内外的公司、企业、其他组织和个人在度假区内投资开发建设旅游设施(包括基础设施)和经营旅游项目。
第五条 合理开发利用并切实保护度假区内的旅游资源。所有开发建设项目必须符合度假区的总体规划,切实保护好城市饮水水源和度假区的自然人文景观与旅游环境。
第六条 度假区的土地依法征收为国家所有。
度假区内的土地实行有偿使用制度。通过依法出让或转让,境内外投资者可以取得土地的使用权。
第七条 度假区应当为投资者提供良好的投资环境。度假区内投资者的资产、收益和其他合法权益,受国家法律、法规和本条例的保护。
第八条 度假区的企事业单位、组织和个人,必须遵守国家法律、法规和本条例。
第九条 度假区设立杭州之江国家旅游度假区管理委员会(以下简称度假区管委会),代表杭州市人民政府实行统一领导和管理。
第十条 度假区管委会依法行使下列职权:
(一)编制度假区的总体规划和发展计划,经杭州市人民政府批准后组织实施;
(二)制定度假区的各项行政管理措施,并组织实施;
(三)审批或审核报批度假区内的投资建设项目;
(四)负责度假区的规划、建设、土地和房地产管理等有关工作;
(五)负责度假区的园林绿化、环境保护工作;
(六)负责度假区的财政、税务、审计、物价、统计、劳动、人事、治安和工商行政管理工作,受托监管国有资产;
(七)管理度假区的旅游业务、对外经济技术合作和其他涉外经济活动;
(八)处理度假区涉外事务;
(九)统一规划和管理度假区的市政公用基础设施;
(十)保障度假区内的企业依法自主经营;
(十一)协调管理有关部门设在度假区内的派出机构的工作;
(十二)杭州市人民政府授予的其他职权。
第十一条 度假区管委会根据工作需要,可设立若干工作机构。
杭州市人民政府有关职能部门在度假区设立的分支机构,由度假区管委会与市政府有关职能部门实行双重领导,以度假区管委会为主。
第十二条 度假区内国税、外汇管理、海关、进出口商品检验等业务工作均由有关部门或其设在度假区的派出机构、分支机构办理。
第十三条 杭州市人民政府有关部门和度假区所在地的人民政府应为度假区的建设发展创造良好条件。
第十四条 度假区鼓励开发建设和经营下列项目:
(一)度假村、宾馆、餐饮、购物设施;
(二)休闲、娱乐、游乐和文化、体育、健身设施;
(三)旅游、现代会展、商务办公、观光农业及其他第三产业项目;
(四)与旅游业直接有关的无污染的生产性项目;
(五)与度假区相配套的公用基础设施。
第十五条 在度假区内兴办企业,由投资者向度假区管委会提出申请,按规定权限和程序批准(旅游项目按生产性项目限额审批)后,依法办理工商登记和税务登记等有关手续。
第十六条 度假区内的企业应当执行国家规定的财务、会计制度和审计制度,并按有关规定向度假区管委会和有关部门报送会计报表和统计报表,接受度假区管委会的监督。外商投资企业报送的年度会计报表,应当经中华人民共和国注册会计师验证。
第十七条 度假区内的企业歇业,应当依照法定程序办理有关歇业注销登记手续,并对其资产和债权债务进行清算。债权债务清理完毕后资产可以转让,属于境外投资者的资金可以按有关规定汇出境外。
第十八条 度假区的企业应当依法建立工会,依法做好劳动保护工作,保障职工的合法权益。
度假区内的企事业单位应当依照国家和省、市的有关规定实行社会保险制度。
第十九条 度假区内的企业职工出国、出境进行技术考察、技术交流和从事本企业商务活动,有关部门应按规定简化出入境审批手续。
第二十条 国家对度假区的优惠政策有规定的,按国家规定执行。
第二十一条 本条例自公布之日起施行。

Article 1 In order to reasonably exploit,
utilize and protect tourism resources, expedite
the construction of tourism facilities, and
prompt the development of Hangzhou tourism
trade in sightseeing & holiday, this regulation
is formulated in light of the related laws
and regulations and resting on the reality
of Hangzhou Municipality.
Article 2 This regulation applies to Zhijang
National Tourist Resort of Hangzhou Municipality
(hereinafter referred to as Tourist Resort)
which is established with the approval of
State Council. Tourist Resort is located in
West Lake District of Hangzhou Municipality.
Article 3 Exploitation and administration
on Tourist Resort shall be applied to with
the special policy and the new-pattern management
system for national tourism resorts so that
Tourist Resort can be built to be a comprehensive
national tourist resort, which serves both
for sightseeing and holiday-spending, meets
the requirements of international tourism
and mainly takes in oversea tourists.
Article 4 Companies, enterprises, other organizations
and individuals at home or abroad shall be
encouraged to invest in the exploitation and
construction of tourism facilities (including
infrastructures), and to operate tourism projects
in Tourist Resort.
Article 5 The resources in Tourist Resort
shall be reasonably exploited and properly
protected. All projects of exploitation and
construction shall conform to the overall
layout for Tourism Resort and well protect
the municipality’s drinking water source and
tourism resources, including scenic spots
and historical sites, located in Tourist Resort.
Article 6 Land within Tourist Resort shall
be requisitioned to be owned by the state
according to law.
Land within Tourist Resort shall be used with
compensation. Investors at home or abroad
may obtain the right to use the land by assignment
or transfer from others in accordance with
law.
Article 7 Tourist Resort shall provide investors
with a favorable investment environment. Invested
asset, income and all other legal rights and
interests of investors in Tourist Resort shall
be protected by national laws and regulations
as well as this regulation.
Article 8 All enterprises, organizations and
individuals in Tourist Resort shall abide
by national laws and regulation as well as
this regulation.
Article 9 In Tourist Resort is set up Administrative
Committee of Zhijang National Tourist Resort
of Hangzhou Municipality (hereinafter referred
to as Administrative Committee), which generally
guides and administrates Tourist Resort on
behalf of the People’s Government of Hangzhou
Municipality.
Article 10 Administrative Committee exercises
the following functions and powers:
to formulate the overall layout and the development
plans for Tourist Resort and organize to carry
out them after they are approved by the People’s
Government of Hangzhou Municipality.
to work out all administrative measures for
Tourist Resort and organize to put them into
practice.
to examine and approve or examine and report
to higher authorities for approval the projects
of investment and construction.
to take charge of the administration on the
layout, the construction, the land and the
real estate and so on in Tourist Resort
to take charge of garden-greening and environment
protection in Tourist Resort.
to be in charge of administration on finance,
tax, audit, price, labor, personnel, security
and industry and commerce of Tourist Resort
and to be commissioned to supervise the national
asset.
to administer tourism trade, foreign cooperation
of economy and technology and other foreign
economical activities in Tourist Resort.
to handle foreign affairs of Tourist Resort.
to unified program and administer municipal
public facilities in Tourist Resort.
to ensure enterprises within Tourist Resort
will operate in conformity with law and independently
.
to reconcile work of detached offices which
are set up in Tourist Resort by the related
departments.
to exercise other functions and powers granted
by the people’s government of Hangzhou Municipality.
Article 11 Due to the demand of work, Administrative
Committee may set up some departments under
it.
The detached offices in Tourist Resort, which
are established by the related functional
departments of the people’s government of
Hangzhou Municipality, shall be dually guided
by Administrative Committee and the municipal
functional departments, but Administrative
Committee is prior to the functional departments.
Article 12 The work in Tourist Resort on national
tax, foreign exchange administration, customs,
inspections on products for import & export
and so on shall be taken by the related department
or their detached offices which are set up
in Tourist Resort.
Article 13 The related departments of the
people’s government of Hangzhou Municipality
and the governments of the place where Tourist
Resort is located shall provide favorable
conditions for the construction and the development
of Tourist Resort.
Article 14 In Tourist Resort it is encouraged
to develop, construct and operate the following
programs:
(1) resort villages, hotels, villas, restaurants,
shopping facilities:
(2) facilities for amusement, culture, sports,
and health
(3)tourism, modern exhibition, commercial
offices, agriculture of sightseeing as well
as other items of the third industry
(4) productive projects directly related with
tourism but without pollution
(5) public infrastructure to match Tourist
Resort
Article 15 To establish an enterprise in Tourist
Resort, investors shall file an application
to Administrative Committee and if getting
approval according to stipulated competence
and procedure (tourism projects shall be examined
and approved in the way as the productive
project quota ) then register in the commercial
and industrial authority and the taxation
bureau and follow other procedure in accordance
with law.
Article 16 Enterprises in Tourist Resort shall
conform to the requirements as stipulated
by national regulations about finance, accounting
and audit, and submit accounting reports and
statistics to Administrative Committee and
other related departments and subject themselves
to supervision of Administrative Committee
in accordance with the related stipulations.
The yearly accounting reports submitted by
foreign-invested enterprises shall be confirmed
by certified public accountants of People’s
Republic of China.
Article 17 Enterprises in Tourist Resort which
intend to go out of business shall handle
the procedures of cancellation of registration
and liquidate its assets, claims and credits
according to legal procedure. After the claims
and credits have been cleared, the remaining
asset may be transferred and the capital belonging
to foreign investors may be remitted abroad
according to law.
Article 18 Enterprises in Tourist Resort shall
by law set up labor unions, provide adequate
protection for staff’s work and assure staff’s
lawful rights and interests.
Enterprise and institution in Tourist Resort
shall implement the stipulations about the
social security system according to the regulations
of the sate, the province and the municipality.
Article 19 If the staff of enterprise in Tourist
Resort needs to go abroad for technical study,
technical exchange and enterprises’ commercial
activities, the related department shall simplify
the examination and approval procedure of
the Exit and Entry for them in accordance
with the regulations.
Article 20 If the state has some regulations
on the favorable policy for Tourist Resort,
the regulations shall be implemented.
Article 21 This regulation shall come into
force as of the date of its promulgation.

第一章 总 则
第一条 为促进和保障杭州高新技术产业开发区(以下简称高新区)的建设和可持续发展,规范高新区管理,保护高新区组织、个人的合法权益,根据国家有关法律法规,结合本市实际,制定本条例。
第二条 本条例所称高新区是指以发展高新技术产业为目的,由杭州市人民政府(以下简称市政府)根据国务院批复,以及杭州市城市总体规划和高新技术产业发展规划划定,并统一管理的区域。
第三条 本条例适用于在高新区从事与本条例相关活动的组织和个人。
第四条 市政府按照省市共管、以市为主的原则,设立杭州高新技术产业开发区管理委员会(以下简称高新区管委会),负责对高新区实行统一规划和管理。
第五条 高新区的发展目标是建设成为科技创新、制度创新、文化创新的示范区,高新技术产业化、科技成果孵化和辐射、创新人才培养集聚基地。
第六条 高新区重点发展电子信息、光机电一体化、生物医药、新材料、新能源等高新技术产业以及其他智力密集型产业。
高新区管委会应当根据科技资源和市场需要,制定产业发展目标,指导高新技术产业发展。
第七条 高新区的组织和个人可以依法享受国家、浙江省以及杭州市促进高新技术产业发展的各项政策。
第二章 市场主体
第八条 任何组织和个人都可以依法在高新区投资、兴办企业或者设立机构。
在高新区设立企业,办理工商登记时,除法律、法规限制经营的项目外,工商行政管理部门对经营范围不作具体核定。
第九条 以高新技术成果作价出资占企业注册资本的比例,可以由出资各方约定。但以国有资产出资的,应当按照国家有关国有资产管理的规定办理。
第十条 高新区的企业和其他市场主体,可以实行股份期权、利润分享、年薪制和技术、管理以及其他智力要素参与权益分配的制度。
第十一条 高新区应当建立和完善社会中介服务体系,为组织和个人的创新创业活动提供中介服务。
第十二条 鼓励具有执业资格的境内外组织和个人在高新区依法设立中介服务机构。
经有关部门认定的科技中介服务机构,享受高新技术企业有关政策。
第十三条 鼓励企业、高等院校、科研机构等其他社会组织和个人在高新区兴办孵化器。经认定的科技企业孵化器享受高新技术企业有关政策。
第三章 促进与保障
第十四条 高新区管委会负责高新技术企业各类科技项目的申报及初审工作。国家、省高新技术项目,由高新区管委会按规定向省有关部门申报立项。
第十五条 经认定的高新技术企业应当在高新区办理税务登记,享受高新技术企业有关政策。
第十六条 鼓励在高新区设立人才、技术产品、技术产权以及其他生产要素市场,促进人才、技术、资本以及其他生产要素有序流动。
经认定的技术产权交易机构享受高新技术企业有关政策。
第十七条 高新区管委会应当每年从其财政支出中安排不低于百分之十五的比例设立产业扶持资金,用于支持高新技术产业发展和中小企业从事创新创业活动等。
经认定的高新技术企业和从事高新技术创新和研发的中小企业都可以申请资金支持。
第十八条 高新区管委会应当建立健全企业信用评价、服务和管理体系。对信用记录良好的企业,在信用担保、产业扶持等方面给予支持。
第十九条 鼓励在高新区依法设立信用担保机构,为中小企业提供以融资担保为主的信用担保。
高新区管委会应当完善中小企业信用担保体系,建立健全信用担保机构和再担保机构的风险补偿机制。
第二十条 鼓励境内外投资主体在高新区设立风险投资机构,从事风险投资活动。
第二十一条 风险投资机构可以运用全额资本金进行投资。
风险投资机构在高新区对高新技术产业项目进行投资,可以按照规定享受高新技术企业有关政策。
第二十二条 风险投资机构可以通过企业购并、股权回购、证券市场上市以及其他方式,回收其风险投资。
第二十三条 高新区应当建立和完善鼓励人才创新创造的分配机制和激励机制。
第二十四条 鼓励境内外各类人才来高新区从事咨询、科研和技术合作、投资创业和其他专业服务,并为其工作、生活提供便利条件。
对以不改变户籍形式来高新区工作和创业的人才,经市有关部门同意,可享受本地人才同等待遇。
第二十五条 鼓励留学归国人员和境外高层次人才来高新区从事创新创业活动,并予以资助。有关部门应当为其出入境、购房以及子女入学提供便利。
第二十六条 高新区管委会应当加强对知识产权保护的指导和服务,提高组织和个人形成、运用、保护知识产权的能力。
第二十七条 禁止在高新区生产、复制、销售和使用盗版的软件和电子出版物。
第二十八条 鼓励高新区内的企业、高等院校、科研机构及相关人员进行专利申请、商标注册、计算机软件著作权登记、集成电路布图设计登记和技术标准的制定,并予以资助。
第二十九条 鼓励企业对知识产权的职务发明者、设计者、作者和主要实施者给予与其实际贡献相当的报酬。
第三十条 网络信息经营者对网络信息的知识产权应当采取保护措施。
未经权利人许可,任何组织和个人不得有下列行为:
(一)利用网络传播他人享有著作权的作品营利;
(二)利用网络公开发布或者改编他人享有著作权的作品;
(三)利用网络侵犯知识产权的其他行为。
第三十一条 高新区的组织和个人的商业秘密受法律保护,任何组织和个人不得以任何方式侵犯他人的商业秘密。
企业与员工可以在劳动合同或者保密合同中约定竞业限制条款,也可以订立专门的竞业限制合同。
第三十二条 鼓励高新区的组织和个人在境外进行投资、融资、经营、研发和国际经济、技术、人才的交流与合作。
第四章 管理与服务
第三十三条 高新区应当按照创新、精简、统一、高效的原则,建立有利于高新技术产业发展,适应市场经济需要的行政管理体制和运行机制。
第三十四条 高新区管委会依法行使下列职权:
(一)编制高新区发展总体规划,经市政府批准后组织实施;
(二)制订高新区内促进高新技术产业发展的政策措施并组织实施;
(三)审核报批高新区内高新技术企业,负责对高新技术企业的考核;
(四)负责高新区的规划、建设、土地、房产和城市管理等有关工作;
(五)负责高新区财政、审计、统计、劳动和社会保障、人事、科技、环境保护、国有资产管理和社会事务等有关工作;
(六)负责高新区基本建设、技术改造和利用外资等投资项目的审批或审核报批;
(七)负责高新区对外经济技术合作和其他涉外经济活动;
(八)协调、管理有关部门设在高新区的派出机构的工作;
(九)市政府授予的或者部门委托的其他职权。
第三十五条 市政府有关部门和高新区所在地的人民政府应当为在高新区从事创新、创业活动的组织和个人提供优质服务,为高新区建设发展创造良好条件。
第三十六条 行政机关及其工作人员应当遵循公开、公平、公正、便民的原则,公开行政审批事项,为企业和其他市场主体提供优质高效服务。
第三十七条 行政机关除法律、行政法规规定的以外,不得对高新区企业进行任何行政性收费。
第三十八条 高新区管委会应当建立项目信息、中介服务信息、统计数据信息等公共信息库,及时公开政务信息和服务信息。
第三十九条 高新区管委会应当按照杭州市城市总体规划,对高新区的建设与发展进行统一规划。
高新区内的建设项目选址、规划管理、设计审批、施工许可及招投标等建设工程管理事项均由高新区管委会统一管理。
高新区的规划编制和建设项目应当进行环境影响评价。
第四十条 高新技术企业的基本建设项目、技术改造项目、利用外资和直接为高新技术产业服务的建设项目,由高新区管委会统一审批或审核报批。
第四十一条 鼓励在高新区投资建设市政基础设施、信息基础设施和其他公共设施。
第四十二条 高新区的土地开发,应当服从高新区建设的统一规划。高新区管委会依法受理规定权限范围内的有关土地管理工作。
第四十三条 市政府有关部门和高新区所在地的人民政府应当采取措施,对高新区内的道路交通、市容环境和垃圾、污水、噪声以及其他危害环境的因素进行治理。
第五章 法律责任
第四十四条 行政机关及其工作人员有下列情形之一的,上级行政机关应当责令改正;情节严重的,应当追究直接责任人员和主要负责人的行政责任;构成犯罪的,依法追究刑事责任:
(一)企业的合法权益因有关行政机关及其工作人员没有依法履行职责而受到侵害的;
(二)企业依照本条例的规定应当享有的权利,因有关行政机关及其工作人员没有依法办理而未能享有的。
第四十五条 行政机关及其工作人员有下列情形之一的,应当依法追究直接责任人和主要负责人的行政责任;情节严重,构成犯罪的,依法追究责任人的刑事责任:
(一)侵犯高新区内企业和个人的合法权益的;
(二)滥用职权或者超越法定职权进行审批的;
(三)利用职权徇私舞弊,非法牟取利益的。
第六章 附 则
第四十六条 市政府应当依据本条例制定有关实施细则。
第四十七条 本条例自2005年1月1日起施行。
Regulations of Hangzhou Municipality on Hi-tech
Industry Development Zone
(Adopted by the 16th Session of the 8th People’s
Congress of Hangzhou Municipality on November
25th, 1994,and approved by the 18th Session
of the Standing Committee of the 8th Zhejiang
Provincial People's Congress on April 29th,
1995.Revised by the 19th session of the Standing
Committee of the 10th People’s Congress of
Hangzhou Municipality on August 27th, 2004,
and approved by the 14th session of the Standing
Committee of the 10th Zhejiang Provincial
People's Congress on November 11th, 2004.)
Chapter I General Provisions
Article 1 For the purposes of promoting and
ensuring construction and sustainable development
of Hangzhou Municipality Hi-tech Industry
Development Zone (hereafter referred to simply
as "hi-tech zone"), regulating the
management of hi-tech zones,safeguarding the
legitimate rights and interests of individuals
and organizations in hi-tech zones, these
regulations are formulated in accordance with
relevant laws and administrative regulations
of the nation and in line with this municipality’s
actual circumstances.
Article 2 The term “hi-tech zone” as mentioned
in these regulations refers to the zone delimited
and administrated unitedly by Hangzhou Municipal
People’s Government ( hereafter referred to
simply as “the Municipal People’s Government”)
, in accordance with the written reply of
the State Council, the overall planning of
Hangzhou and the development plan of hi-tech
industries, so as to develop hi-tech industries.
Article 3These regulations shall be applicable
to the individuals and organizations engaged
in activities relevant to theses regulations
in hi-tech zones.
Article 4 In the light of the principle “Administrated
by the province and the municipality together,
mainly by the municipality”, the Municipal
People’s Government sets up Management Committee
of Hangzhou New and High Technology Industrial
Development Zone (hereafter referred to simply
as “Management Committee of Hi-tech Zones"),
which is responsible for the unified planning
and management of hi-tech zones.
Article 5 The objective of hi-tech zones is
to be demonstration zones of technological
innovation, systematic innovation and cultural
innovation, and to be bases for industrialization
of new and high technology, bases for incubation
and radiation of scientific and technological
achievements and bases for cultivation and
congregation of innovative talents.
Article 6 Hi-tech zones concentrate on developing
electronic information technology, mechanical
and electronic integration technology, bio-tech
and pharmaceutical technology, new materials
technology, new energy resources technology
and other intelligence-intensive industries.
Management Committee of Hi-tech Zones shall
set down objectives of the industrial development
in line with scientific and technological
resources and market demand, so as to direct
the development of hi-tech industries.
Article 7 According to law, organizations
and individuals in hi-tech zones may enjoy
various policies made by the State, Zhejiang
Province or Hangzhou Municipality to promote
the development of hi-tech industries.
Chapter II Market Subjects
Article 8 Any organization or individual may
invest in enterprises, embark on enterprises
or establish branches in hi-tech zones in
accordance with law . With regard to these
enterprises established in hi-tech zones,
industry and commerce administration departments
do not check and ratify the scope of business
concretely during the industrial and commercial
registration except for items within the scope
subject to restrictions under laws and rules.
Article 9 Where hi-tech achievement is invested
as intangible property in an enterprise, its
percentage of the registered capital may be
approved through consultation by the investors
concerned. But investment in the form of State
owned assets shall be handled in line with
the provisions on management of State owned
assets.
Article 10 Enterprises and other market subjects
may carry out systems such as stock option,
profit sharing, annual salary system, and
the system of technological, managerial and
other intellectual factors participating in
the distribution of rights and interests.
Article 11 Hi-tech zones shall erect and perfect
the social intermediary service system, so
as to provide intermediary services for innovation
and business-starting activities of organizations
and individuals.
Article 12 The licensed organizations and
individuals at home and abroad shall be encouraged
to set up intermediary service agencies in
hi-tech zones in accordance with law . The
technology intermediary service agencies approved
by relevant departments may enjoy policies
on hi-tech enterprises.
Article 13 Social organizations including
enterprises , institutions of higher learning
and scientific research institutes shall be
encouraged to set up incubators in hi-tech
zones. The approved incubators of technological
enterprises may enjoy policies on hi-tech
enterprises.
Chapter III Promotion and Ensurance
Article 14 Management Committee of Hi-tech
Zones is responsible for declaration and preliminary
examination of various technological projects
of hi-tech enterprises. With regard to the
projects which to be accredited by State or
the province, Management Committee of Hi-tech
Zone shall file and report to the projects
with the provincial departments concerned
in accordance with relevant provisions.
Article 15 The approved hi-tech enterprises
shall handle the tax registration in hi-tech
zone, and may enjoy policies on hi-tech enterprises.
Article 16 Establishment of factor market
including technological product market, technological
property right market and talent market in
hi-tech zones shall be encouraged, so as to
promote orderly flow of factors of production
including talents, technology and capital.
The approved technological property right
exchange may enjoy policies on hi-tech enterprises.
Article 17 Management Committee of Hi-tech
Zones shall prepare at least 15% of its expenditure
for financial support fund annually, so as
to support the development of hi-tech industries
and innovation and business-starting activities
of small and medium-sized enterprises. The
approved hi-tech enterprises and small and
medium-sized enterprises engaged in hi-tech
innovation and research & development,
may apply for financial aid from this fund.
Article 18 Management Committee of Hi-tech
Zones shall erect and perfect the enterprises
credit assessment system, service system and
management system. The enterprises with good
credit record shall be given support in credit
guaranty, industry support, and so on.
Article 19 Guarantee agencies shall be encouraged
to be set up in hi-tech zones in accordance
with law, so as to provide small and medium-sized
enterprises with credit guaranty focused around
financing guarantee. Management Committee
of Hi-tech Zones shall perfect credit guaranty
system of small and medium-sized enterprises,
erect and perfect the risk compensation mechanism
of guarantee agencies and reguarantee agencies.
Article 20 Subjects of investment at home
and abroad shall be encouraged to set up venture
capital agencies engaged in venture capital
activities in hi-tech zones.
Article 21 Venture capital agencies may invest
with full capital, those agencies investing
in projects of hi-tech industries may enjoy
policies on hi-tech enterprises according
to relevant provisions.
Article 22 Venture capital agencies may recoup
the capital outlay by enterprise acquisition
& merger, stock buyback, come into the
securities market and other ways.
Article 23 Hi-tech zones shall erect and perfect
distribution system and stimulation system,
so as to encourage talents to innovate.
Article 24 All kinds of talents at home and
abroad shall be encouraged to come to hi-tech
zones and engage in consultation, scientific
research, technological cooperation, business-starting
investment and other professional services.
The talents above may be provided with conveniences
in work and life. With the permission of relevant
departments of the municipality, talents without
local domiciliary register working or starting
business in hi-tech zones may enjoy the same
treatment as those local talents.
Article 25 The returned overseas talents and
high talents abroad shall be encouraged to
come to hi-tech zones and engage in innovation
and business-starting activities, and talents
above may be provided with financial help.
The relevant departments shall provide them
with conveniences in entry and exit, buying
a house and enrollment of minor children.
Article 26 Management Committee of Hi-tech
Zones shall strengthen guidance and service
of protection of intellectual property, and
improve abilities of organizations and individuals
to acquire, exercise and protect intellectual
property.
Article 27 Producing, selling, reproducing
and exploiting piratical software and E-journal
shall be prohibited in hi-tech zones.
Article 28 Enterprises, institutions of higher
learning, scientific research institutes and
relevant personnel in hi-tech zones shall
be encouraged to apply for patent, register
trademark, register copyright of computer
software, register layout-designs of integrated
circuits and set technical standards. And
